1. Platform Purpose & Limitations

Crew App is a software platform and content curation service designed to help construction and trades companies organize, access, and manage safety-related information. Crew App is NOT:

  • A safety consulting service
  • A replacement for qualified safety professionals
  • A guarantee of workplace safety or regulatory compliance
  • Professional safety advice tailored to your specific workplace
  • A substitute for your own safety programs, policies, or training

2. Warranty Disclaimer

CREW APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.

3. No Guarantee of Compliance or Safety

While Crew App provides access to safety documents, procedures, and training materials, we make no representations or warranties that:

  • The information provided is complete, current, or accurate for your specific workplace
  • Use of Crew App will result in compliance with any workplace safety regulations
  • The content is suitable for your particular operations, equipment, or hazards
  • The platform will prevent workplace incidents, injuries, or violations

4. Assumption of Risk

You acknowledge that construction and trades work involves inherent risks and hazards. By using Crew App, you expressly assume all risks associated with workplace safety decisions, including any reliance on information provided through the platform. You understand and agree that Crew App is a tool to assist with safety management, not a substitute for professional judgment, proper training, or adequate safety programs.

5. Customer Responsibilities

You, the customer, are solely responsible for:

  • Ensuring compliance with all applicable federal, provincial, and municipal safety regulations
  • Developing and implementing your own safety policies and procedures
  • Verifying the accuracy and applicability of all content for your specific workplace
  • Providing proper supervision, training, and safety oversight to your employees
  • Maintaining adequate safety programs independent of Crew App
  • Consulting with qualified safety professionals as needed
  • Ensuring all personnel using Crew App understand it is a tool, not a safety program
  • Monitoring regulatory changes applicable to your operations and ensuring your safety programs remain compliant regardless of platform content

6. Indemnification

You agree to indemnify, defend, and hold harmless Crew App, Crew Digital Solutions Ltd., its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

  • Your use of the platform
  • Your violation of these terms
  • Your failure to comply with applicable safety regulations
  • Any workplace incident, injury, or regulatory action at your worksite
  • Any claim that your use of Crew App content caused harm to any third party
  • Any content you upload or distribute through the platform

7. Content Disclaimer

Safety Data Sheets (SDS), Safe Job Procedures (SJP), Safe Work Practices (SWP), and other documents provided through Crew App are general reference materials curated from publicly available sources or created as general guidance. This content:

  • May not reflect the most current regulatory requirements
  • Is not tailored to your specific workplace hazards or operations
  • Must be reviewed and approved by your qualified safety personnel before use
  • Should be supplemented with site-specific information and requirements
  • May require modification to meet your applicable regulations

8. Training & Crew Academy Disclaimer

Training courses provided through Crew Academy are educational resources and do not guarantee:

  • Certification or qualification for any specific job or task
  • Compliance with employer-specific or regulatory training requirements
  • Competency or safe work performance
  • That completion of training meets all applicable regulatory requirements in your jurisdiction

Employers remain responsible for ensuring all training meets their specific requirements and applicable regulations.

9. AI Assistant Disclaimer

Any responses provided by AI-powered features within Crew App (including but not limited to "Norman the Foreman") are generated by artificial intelligence and are provided for informational purposes only. AI responses:

  • May be inaccurate, incomplete, or inappropriate for your specific situation
  • Must be independently verified before being acted upon
  • Should not be relied upon as professional safety advice or regulatory guidance
  • Do not create any professional, consulting, or advisory relationship

You are solely responsible for evaluating the accuracy and appropriateness of any AI-generated content for your specific workplace and operations.

10. Limitation of Liability

To the maximum extent permitted by law, Crew App, Crew Digital Solutions Ltd., its owners, operators, employees, and affiliates shall not be liable for:

  • Workplace incidents, injuries, illnesses, or fatalities
  • Regulatory violations, fines, penalties, or enforcement actions
  • Inaccurate, incomplete, or outdated information provided through the platform
  • Reliance on content without independent verification
  • Any direct, indirect, incidental, consequential, or punitive damages arising from use of Crew App
  • Any claims brought by your employees, contractors, subcontractors, or any third parties arising from workplace incidents, regardless of any alleged connection to Crew App content or services

Aggregate Liability Cap: In no event shall Crew App's total liability to you for all claims arising from or related to your use of the platform exceed the total fees paid by you to Crew App during the twelve (12) months preceding the claim, or one hundred dollars (CAD $100), whichever is greater.

11. Professional Advice Disclaimer

Nothing in Crew App constitutes professional safety advice, legal advice, or consultation services. You should consult with qualified safety professionals, legal counsel, or regulatory authorities for guidance specific to your workplace and operations.

12. Regulatory Changes

Safety regulations change frequently. Crew App does not guarantee that platform content will be updated to reflect regulatory changes on any particular timeline. You are solely responsible for monitoring regulatory changes applicable to your operations and ensuring your safety programs remain compliant regardless of platform content.

While Crew App was developed with consideration for Nova Scotia workplace safety regulations, content may not reflect the most current requirements under the Nova Scotia Occupational Health and Safety Act or other applicable regulations. You are responsible for ensuring compliance with all applicable federal, provincial, and municipal regulations and contacting the appropriate regulatory authorities for authoritative guidance.

13. User-Generated Content

Content uploaded by users to Crew App (including company policies, custom procedures, or documents) is the sole responsibility of the uploading organization. Crew App does not review, verify, or endorse user-uploaded content.

14. Dispute Resolution & Governing Law

These terms shall be governed by and construed in accordance with the laws of the Province of Nova Scotia and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute arising from these terms or your use of Crew App shall be resolved through binding arbitration in Halifax, Nova Scotia, in accordance with the arbitration rules then in effect in Nova Scotia. You agree that any arbitration shall be conducted on an individual basis only.

15. Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Crew App, Crew Digital Solutions Ltd., or any of its affiliates.

16. Severability

If any provision of these terms is held to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, shall be severed from these terms. All other provisions shall remain in full force and effect.

17. Changes to Service & Terms

Crew App reserves the right to modify, update, or discontinue features, content, or the service at any time without notice. We may also update these terms from time to time. Continued use of the platform after any changes constitutes acceptance of the updated terms. We are not liable for any modifications or interruptions to the service.

18. Acceptance of Terms

By using Crew App, you acknowledge that you have read, understood, and agree to these terms and disclaimers. If you do not agree, you should not use the platform.
